Términos y condiciones

1. RESERVATION PROCESS

A reservation shall be deemed confirmed once RAMBLE PERÚ has received a duly completed booking form along with a deposit amounting to 40% of the total cost of the service. The outstanding balance must be paid in cash upon the client’s arrival in Huaraz, no later than two (2) days prior to the scheduled departure date. Failure to settle the remaining balance within the stipulated period shall be considered a cancellation by the client, and the applicable cancellation fees shall be enforced in accordance with Section 2 below.

2. CANCELLATIONS

In the event that cancellation of the reservation becomes necessary, the client must provide immediate written notification in order for the cancellation to take effect. The following terms shall apply:

  • For cancellations made more than sixty (60) days prior to the departure date, the client shall be entitled to a refund of the deposit paid, subject to a deduction of fifteen percent (15%) to cover bank transfer fees, commission charges, and currency exchange costs.
  • For cancellations made between thirty-one (31) and fifty-nine (59) days prior to the departure date, the client shall be entitled to a refund of the deposit paid, subject to a deduction of twenty-five percent (25%) for the aforementioned expenses.
  • For cancellations made between sixteen (16) and twenty-nine (29) days prior to the departure date, the client shall be entitled to a refund of the deposit paid, less a deduction of fifty percent (50%) for the aforementioned expenses.
  • For cancellations made between eight (8) and fifteen (15) days prior to the departure date, the client shall be entitled to a refund of the deposit paid, subject to a deduction of eighty percent (80%) for the aforementioned expenses.
  • For cancellations made within seven (7) days prior to the departure date, the client shall forfeit one hundred percent (100%) of the deposit paid.

For the purposes of these terms and conditions, "the cost of the trip" shall be understood to include the price of any additional services reserved for said trip. The trip cost is quoted as an indivisible package; therefore, no partial refunds shall be granted under any circumstances.

In cases of medical emergencies or force majeure events, clients may postpone their trip once only, provided that a formal written request is submitted to RAMBLE PERÚ at least seven (7) days prior to the scheduled departure date. Any rescheduling shall be subject to applicable rate adjustments according to seasonal variations.

3. MEDICAL DECLARATION

You hereby declare and warrant that:

  • You are in good mental and physical health at the time of booking this trip.
  • You have disclosed to RAMBLE PERÚ all matters relating to your health, physical condition, and mental state of which you are aware, or of which you reasonably should be aware, that may be relevant to RAMBLE PERÚ’s decision to permit your participation in the adventure trip.
  • You shall immediately inform RAMBLE PERÚ of any adverse change to your health or physical condition that may affect the company’s decision to allow your continued participation in the adventure trip.
  • You acknowledge that the duty of disclosure described in this condition continues from the time of booking through to the departure date and for the entire duration of the trip.
  • Failure to disclose relevant health information to RAMBLE PERÚ shall release the company from any liability for personal injury or death suffered during the trip.
  • RAMBLE PERÚ shall not be liable for any damage to property or loss incurred by you. However, nothing in this clause shall exclude or limit our liability for fraud, death, or personal injury resulting from our negligence.

4. OUR GUIDES

RAMBLE PERÚ employs officially licensed and certified guides who are authorized to conduct guiding activities within the framework of Peruvian law. All guides are duly registered in the National Directory of Tourism Service Providers – Tourist Guides.

The designated guides of RAMBLE PERÚ take their responsibilities very seriously. Should a designated guide or the company’s management, at their absolute discretion, determine that you should not participate in the trip prior to departure, you may be excluded from the trip. In such a case, subject to the provisions of Condition 3, you will be offered the option of joining another trip deemed suitable for you or receiving a full refund.

A designated guide may determine that you are unable to continue the trip under the following circumstances:

  • You have committed an illegal act (theft, harassment, sexual harassment, or assault).
  • Your behavior is causing, or is likely to cause, danger, distress, or significant annoyance to others.
  • Your physical or mental health is deemed inadequate to continue, in which case you must follow the instructions of the designated guide.
  • You are suffering from acute mountain sickness in a manner that could compromise your health or pose a life-threatening risk.

In all of the above circumstances, you shall not be entitled to any refund.

RAMBLE PERÚ reserves the right to change the designated guide for any trip at any time. Should this occur, RAMBLE PERÚ will make every effort to ensure that the replacement guide possesses comparable experience to that of the original guide. Such changes shall not constitute grounds for you to cancel the tour or to claim any expenses, losses, or damages.

5. ROUTE CHANGES, POSTPONEMENT, CANCELLATION, OR DELAY

RAMBLE PERÚ reserves the right to:

  • Modify any trip itinerary;
  • Cancel or amend any route or objectives outlined in the itinerary;
  • Substitute alternative or equivalent routes within the trip in place of those cancelled or amended;
  • Postpone, cancel, or delay (whether relating to departure or arrival times, or the duration of the trip).

The reasons RAMBLE PERÚ may consider changes, modifications, postponements, or cancellations include, but are not limited to, adverse weather conditions, snow or ice conditions, or any other dangerous conditions; political, military, or terrorist events; real or perceived health risks (including pandemics, epidemics, or health alerts in the area where activities are conducted); or any other circumstances that RAMBLE PERÚ deems necessary for the safety of participants or its designated staff, or if an act or omission of a third party prevents the trip from being carried out as originally booked.

In the event of any change, modification, cancellation, postponement, or delay under this condition, you acknowledge that you shall not be entitled to any refund of the trip price (whether in whole or in part), nor shall you be entitled to claim compensation for any injury, loss, damage, or additional expenses incurred as a result of such change.

Should any such changes, whether before or during the trip, incur additional costs (including accommodation and ground transportation), you agree to pay such additional costs as reasonably requested by RAMBLE PERÚ.

RAMBLE PERÚ also reserves the right, at its sole discretion, to cancel any trip in response to government travel warnings or advisories.

6. FORCE MAJEURE

RAMBLE PERÚ shall not be liable and shall be entitled to cancel any trip due to force majeure events, including but not limited to strikes, industrial disputes, fire, breakdowns, road disruptions, government actions or policies, acts of war or terrorism, acts or omissions of third parties, or any other cause. In such circumstances, you may either cancel the trip or accept alternative arrangements as specified under Condition 5. RAMBLE PERÚ will endeavor to offer the best available alternatives to ensure your safety and minimize financial loss, proposing options similar to the original reservation whenever possible.

7. ACCEPTANCE OF RISKS

You acknowledge that:

  • Due to the nature of adventure travel and trekking holidays, these activities are more challenging and demanding, involving a significantly greater degree of risk compared to conventional holidays; additional dangers and risks may include hazardous terrain, high altitudes, extreme weather conditions including sudden and unexpected changes, political instability, remoteness from normal medical services and communications, and difficulties in evacuation in the event of illness or injury.
  • Part of the enjoyment and excitement of adventure travel arises from the inherent dangers and risks associated with such activities, and these risks are among the reasons you wish to undertake the adventure trip; the very nature of adventure travel may require considerable flexibility on your part, with alternative arrangements made on short notice.
  • You have submitted your booking after carefully considering relevant travel information, including but not limited to any travel advice or warnings issued by the Foreign Affairs Ministry or equivalent authorities of your country regarding Peru, and it is your responsibility to familiarize yourself with such information.
  • For the reasons outlined above, you accept the inherent and increased dangers and risks associated with the proposed trip, and you acknowledge the risk of potential injury, death, or material loss or damage.
